Terms & Conditions

The following disclaimer applies to all users of UniGuard Pro (“the Service”), including its website, mobile applications, cloud platform, monitoring dashboard, integrations, and any related products or services provided by UniGuard Pro. (“the Company”).

1. No Warranty / Service Provided “As-Is”

UniGuard Pro is provided on an “as-is” and “as-available” basis. The Company makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, uptime, reliability, or non-infringement.
We do not guarantee that the Service will operate without interruptions, errors, delays, or security vulnerabilities.

2. No Guarantee of Detection or Prevention

While UniGuard Pro may provide alerts, recorded video, live monitoring features, AI-assisted analytics, or integrations with third-party hardware/software, the Company does not guarantee:

  • Detection of all events, intrusions, criminal activity, or emergencies

  • Prevention of loss, theft, personal injury, or property damage

  • The accuracy or reliability of any notifications or analytics

Users understand that no security system is foolproof, and the Service is intended to assist, not replace, proper safety practices, physical security, or professional monitoring unless expressly included in the user’s plan.

3. Limitation of Liability

To the fullest extent permitted by law, Nickel City Security Inc. and its owners, employees, partners, or affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to:

  • Loss of data or recordings

  • Business interruption

  • Loss of profits or revenue

  • Property damage

  • Personal injury

  • Failure of the Service or equipment

  • Third-party actions, integrations, or outages

The user agrees that any liability of the Company is strictly limited to the amount paid by the user in the previous 12 months for the Service.

4. User Responsibility

Users are solely responsible for:

  • Maintaining stable internet connectivity and power

  • Ensuring cameras, devices, or software are installed and configured correctly

  • Complying with local privacy, video surveillance, and audio-recording laws

  • Preventing unauthorized access to their accounts

  • Testing their system regularly

  • Backing up essential footage, data, or logs

The Company is not responsible for equipment failure, improper installation, or local network issues unless directly provided as part of a paid service plan.

5. Third-Party Integrations and Services

UniGuard Pro may integrate with third-party platforms (e.g., ONVIF devices, Angelcam, UniFi Protect, Alarm.com, cloud storage providers, AI services).
The Company does not control, endorse, or guarantee any third-party service and is not liable for their performance, reliability, outages, or data practices.

Use of third-party services is entirely at the user’s risk and subject to their respective terms.

6. No Emergency Response Guarantee

Unless the user is subscribed to a formal, contracted 24/7 monitoring plan, UniGuard Pro does not provide emergency response, dispatch, or real-time supervision of any kind.
For monitored clients, response times are not guaranteed and may be affected by external factors outside the Company’s control.

UniGuard Pro is not a replacement for 911 or emergency services.

7. Data, Recording, and Storage Disclaimer

Video, audio, and event data may fail to save, transmit, or be accessible due to:

  • Device malfunctions

  • Network issues

  • Cloud server outages

  • Storage limitations

  • User configuration errors

The Company is not responsible for lost recordings, corrupted data, or failed footage retrieval.

8. Laws & Compliance

The user is solely responsible for complying with:

  • Federal, provincial, and municipal privacy laws

  • Consent requirements for audio/video recording

  • Surveillance signage requirements

  • Any restrictions or licensing related to monitoring equipment

The Company does not provide legal advice and encourages users to seek independent legal counsel if unsure.

9. Indemnification

The user agrees to indemnify, defend, and hold harmless the Company from any claims, damages, legal actions, fines, or liabilities arising out of:

  • Misuse of the Service

  • Illegal installation, use, or monitoring

  • Violations of privacy or recording laws

  • Actions taken (or not taken) based on alerts or analytics

  • Third-party claims resulting from user behavior

10. Right to Modify or Discontinue

The Company reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
The Company is not liable for any impact such changes may have on the user’s business or operations.
